5. Response to DMCA Notices
Upon receiving a substantially compliant DMCA notification, Selaahost will review the complaint and take appropriate action in accordance with applicable law.
Depending on the circumstances, we may:
- Review the reported material and associated hosting account.
- Request additional information where the notification is incomplete.
- Remove or disable access to allegedly infringing content expeditiously where required.
- Notify the affected customer or account holder.
- Provide information about the counter-notification process.
- Take further action against accounts associated with repeated copyright infringement.
Where appropriate, affected customers will be informed of the complaint and given an opportunity to respond.
We reserve the right to address violations of our Terms of Service or other legal requirements independently of the DMCA process.
6. DMCA Counter-Notification
If you believe that your content was removed or disabled because of a mistake or misidentification, you may submit a written counter-notification to our designated DMCA agent.
To be effective under 17 U.S.C. § 512(g)(3), your counter-notification must substantially include:
- Your Signature: A physical or electronic signature.
- Identification of Removed Material: A description of the material removed or disabled, together with the location where it appeared before removal.
- Statement Under Penalty of Perjury: A statement that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Contact Information and Consent to Jurisdiction: Your name, address, and telephone number, together with a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located or, if your address is outside the United States, any judicial district in which the service provider may be found. You must also agree to accept service of process from the person who submitted the original infringement notification or their agent.
Counter-notifications should be directed to the designated DMCA agent using the contact details provided in Section 4.
Submitting a counter-notification may have legal consequences. Customers should ensure that the information provided is accurate.
7. Restoration of Removed Content
When Selaahost receives a valid DMCA counter-notification under the applicable statutory process, we will promptly forward a copy to the party who submitted the original infringement notice and inform that party of the potential restoration.
Subject to the requirements of the DMCA, we will restore the removed material or cease disabling access no fewer than 10 and no more than 14 business days after receiving the counter-notification, unless our designated agent first receives notice that the original complaining party has filed an action seeking a court order to restrain the alleged infringement.
Content removed for separate legal, security, or contractual reasons may remain restricted independently of the DMCA counter-notification process.
8. Repeat Infringer Policy
Selaahost respects copyright protections and maintains a policy providing for the termination, in appropriate circumstances, of accounts belonging to repeat infringers.
We may take actions including:
- Issuing copyright infringement warnings.
- Removing or disabling access to infringing material.
- Suspending hosting services.
- Restricting access to affected accounts.
- Terminating accounts of repeat infringers in appropriate circumstances.
Enforcement decisions will depend on the circumstances, available evidence, applicable law, and our Terms of Service.
9. Customer Responsibilities
Customers who use Selaahost hosting and infrastructure services are responsible for ensuring that the content they upload, publish, store, or distribute complies with applicable copyright and intellectual property laws.
Customers must not knowingly use our services to:
- Distribute copyrighted material without required authorization.
- Host pirated software, movies, music, or other unlawfully reproduced content.
- Operate websites intended to facilitate unlawful copyright infringement.
- Distribute content that infringes the intellectual property rights of third parties.
- Circumvent applicable copyright protections unlawfully.
Customers are responsible for obtaining necessary licenses, permissions, or other legal authorization for content hosted through their accounts.
10. Third-Party and Externally Hosted Content
Selaahost may provide infrastructure used by independent customers to operate websites, applications, and other online services.
Customer-hosted content is generally managed by the relevant account holder rather than directly created or controlled by BACNA LLC.
Some services may also involve third-party infrastructure providers, domain registrars, or other external service partners.
When a complaint concerns material that is not hosted or controlled by Selaahost, we may direct the reporting party to the appropriate service provider or take other reasonable action within our authority.
Domain name registration alone does not necessarily establish that website content is hosted by Selaahost.
11. Misrepresentation and False Claims
Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to liability for resulting damages, including certain costs and attorneys’ fees.
All parties submitting DMCA notices or counter-notifications are expected to provide truthful and accurate information.
Selaahost reserves the right to address abusive complaints or fraudulent submissions in accordance with applicable law.
12. Standard Technical Measures
Selaahost will accommodate and not interfere with standard technical measures used by copyright owners to identify or protect copyrighted works, to the extent required under applicable provisions of the DMCA.
We are committed to maintaining reasonable procedures for responding to copyright complaints involving our services.
13. Privacy and Disclosure of Information
When processing DMCA complaints, Selaahost may collect and use contact details, infringement allegations, supporting materials, and related account information.
To administer the DMCA process, we may share relevant information with:
- The customer associated with the reported content.
- The copyright owner or authorized reporting party.
- Legal representatives.
- Relevant service providers.
- Courts, law enforcement, or regulatory authorities where legally required.
Counter-notifications may be forwarded to the original complaining party as part of the statutory process.

14. No Waiver of Legal Rights
Nothing in this policy is intended to waive, limit, or exclude any legal right or obligation that cannot lawfully be waived, limited, or excluded.
Our publication of this policy does not independently establish eligibility for any limitation of liability or safe harbor protection under the DMCA.
Such protections depend on satisfying applicable statutory requirements.
15. Changes to This DMCA Policy
BACNA LLC may revise this DMCA Policy to reflect changes in applicable laws, hosting services, operational procedures, or copyright enforcement requirements.
Updates will be published on this page with a revised effective date.
We encourage customers and copyright owners to review this policy periodically.
